Our Commitment to You

Please read these terms carefully before booking. They set out your rights and obligations when you book a tour with Nomad Explorer Tours.

1. The Contract

A contract exists between Nomad Explorer Tours ("the Company") and the person making the booking ("the Client") once a deposit has been received and a confirmation invoice has been issued. By booking, you agree to these terms on behalf of yourself and all persons named on the booking. All services are subject to these terms and conditions.

2. Booking and Payments

To secure your reservation, a non-refundable deposit of 30% of the total tour price is required at the time of booking. For group joinings or specific peak season bookings, this amount may vary. The booking is only confirmed once the deposit reflects in our account.

The balance of the tour price must be paid at least 30 days before the tour start date. If the balance is not paid on time, the Company reserves the right to cancel the booking and retain the deposit. For bookings made within 30 days of departure, full payment is required immediately.

Payments can be made via bank transfer or credit card. Please note that credit card payments may incur a surcharge to cover processing fees. Details will be provided on your invoice.

3. Cancellation by Client

Cancellations must be received in writing (email is acceptable). The following cancellation fees apply based on the date the written notification is received by the Company:

  • More than 60 days before tour start date: Loss of deposit.
  • 31 - 60 days before tour start date: 50% of total tour cost.
  • Less than 30 days before tour start date: 100% of total tour cost.

No refunds will be issued for unused services, late arrivals, or premature departures.

4. Cancellation by the Company

The Company reserves the right to cancel a tour for any reason, including but not limited to insufficient bookings, operational difficulties, or events of force majeure (e.g., war, civil unrest, natural disasters, epidemics, government travel warnings, or other circumstances beyond our control).

In such cases, the Company will offer an alternative tour of comparable standard or a refund of monies paid, minus any non-refundable costs already incurred by the Company (e.g., non-recoverable flight deposits, park fees, or accommodation prepayments). The Company is not responsible for any incidental expenses that you may have incurred as a result of your booking, such as visas, vaccinations, or non-refundable flights.

5. Prices & Surcharges

All tour prices are quoted in United States Dollars (USD) unless otherwise specified.

Prices are based on costs prevailing at the time of publication and are subject to change without prior notice. This may include, but is not limited to, increases in park fees, government taxes, fuel costs, or adverse currency fluctuations.

Should a price increase exceed 10% of the total tour cost, you will have the option to cancel your booking and receive a full refund of all monies paid, provided you notify us in writing within 14 days of receiving the surcharge notification.

6. Changes to Itinerary

By the Client: Any changes to a confirmed itinerary requested by the Client after booking may incur additional charges. These changes are subject to availability and the discretion of the Company and its suppliers. An administration fee may also apply.

By the Company: While every effort is made to adhere to the confirmed itinerary, the Company reserves the right to make necessary changes due to unforeseen circumstances, local conditions, or operational requirements. Such changes will be made with the Client's best interests in mind, and alternatives of comparable standard will be provided where possible. The Company will not be liable for any compensation in such instances.

7. Travel Insurance

Travel insurance is mandatory for all clients booking with Nomad Explorer Tours. Your insurance must cover personal accident, medical expenses, emergency evacuation/repatriation, and cancellation/curtailment. You must provide proof of adequate insurance coverage before the start of the tour.

8. Health & Safety

It is the Client's responsibility to disclose any pre-existing medical conditions, allergies, or disabilities that may affect their ability to participate in the tour activities. The Company reserves the right to refuse participation if, in its sole discretion, it determines that a Client's health condition poses a risk to themselves or others.

Clients are responsible for obtaining all necessary vaccinations (e.g., Yellow Fever) and taking recommended malaria prophylaxis as advised by their medical practitioner. Please consult your doctor well in advance of your travel date.

The Company and its guides reserve the right to remove any Client from a tour if their health or behavior is deemed detrimental to the safety, enjoyment, or well-being of the group or themselves.

9. Passports & Visas

It is the Client's sole responsibility to ensure they possess valid passports (with at least 6 months validity remaining from the date of entry), appropriate visas, and any other necessary travel documents for entry into Tanzania and any transit countries. The Company is not liable for any costs or losses arising from the Client's failure to comply with these requirements.

10. Liability

Nomad Explorer Tours acts solely as an agent for various independent suppliers, including but not limited to hotels, airlines, ground operators, and other service providers. We exercise all reasonable care in selecting reputable suppliers.

However, the Company is not liable for any loss, damage, injury, delay, inconvenience, or expense incurred by the Client due to the acts, omissions, or negligence of these independent suppliers, or due to events of force majeure, theft, accident, illness, or any other cause beyond our direct control.

Participation in adventure travel activities, such as safaris and trekking, involves inherent risks. By booking, the Client acknowledges these risks and agrees to assume full responsibility for their own safety and well-being.

11. Complaints

In the unlikely event of a complaint, please bring it to the attention of your guide or our Moshi/Arusha office immediately so we can attempt to resolve it during your trip. If the issue remains unresolved, you must submit your complaint in writing to the Company within 14 days of the tour's completion. Failure to do so may compromise the Company's ability to investigate and resolve the matter.

12. Authority on Tour

The decision of the Company's tour leader or guide is final on all matters likely to endanger the safety or well-being of the group. The Client must at all times comply with the laws, customs, and foreign exchange regulations of the United Republic of Tanzania.

13. Wildlife Viewing

While our safaris are designed to maximize wildlife viewing opportunities, the presence of specific animals cannot be guaranteed. Wildlife behavior is unpredictable, and sightings depend on various factors including weather, season, and animal movements. The Company cannot be held responsible for the non-sighting of specific wildlife.

14. Photography for Promotional Use

The Company reserves the right to use any photographs or videos taken by its staff during the tour for promotional purposes, including on its website, social media, and marketing materials. Clients who do not wish to have their image used must notify the Company in writing prior to the start of the tour.

15. Baggage

Baggage allowance on safari vehicles is generally limited to one soft-sided bag (duffel bag) and one daypack per person. Hard-shell suitcases are not recommended due to space constraints. Specific weight limits may apply for domestic flights within Tanzania, and clients will be advised accordingly.

16. Special Requests

Any special requests (e.g., dietary requirements, room preferences, medical needs) should be communicated to the Company at the time of booking. While we will endeavor to accommodate such requests, they cannot be guaranteed and do not form part of the contract. Failure to meet a special request will not be considered a breach of contract.

17. Environmental Responsibility

Clients are expected to adhere to responsible tourism practices, including respecting wildlife, avoiding littering, minimizing environmental impact, and following all park rules and regulations. Guides will provide specific guidelines during the tour, and adherence is mandatory.

18. Governing Law

These terms and conditions are governed by the laws of the United Republic of Tanzania and any disputes will be subject to the exclusive jurisdiction of the Tanzanian courts.
